1 Period that does not count as laytime even if loading or discharging is carried out. 2 When allowable laytime has been exceeded ship shall remain on demurrage until completion of loading. 3 "Laytime" means time allowed to load the cargo on the mother vessel. 4 Time lost due to waiting for berth available at Discharging Port , in case the laytime commences, shall be counted as the laytime. 5 Shifting time from anchorage to the loading berth shall not count towards laytime, or, if vessel is already on demurrage, always on demurrage. 6 Should the buyer require discharging the goods at two berths in the same port, the fee and charges and laytime for the shifting between two berths shall be at Buyer's cost and expenses. 7 Such discharging rate and the weight determined by the draft survey in accordance with Clause 8.2 shall be the basis for the laytime calculation, fractions prorata. 8 Time lost in connection with the first opening and last closing of vessel hatches shall not count as laytime unless the vessel is already on demurrage. 9 Time lost for repairing stevedore damage is to count as laytime or time on demurrage.
